The CAUBE.AU ISP Logo Program
(the Program) is open to any Internet Service
Provider, Internet Access Provider, or Internet
Presence Provider operating in Australia..
An organisation becomes a
participant in the Program by placing the
CAUBE.AU ISP OK Logo (the Logo) on any of their
web pages, and any such placement is taken to
constitute acceptance of these terms.
A participant may use the Logo on
their home page, their policy page and their
abuse handling page.
The Logo must be placed on web
pages such that:
the logo itself is a
hyperlink to http://www.caube.org.au/cgi-bin/isppgm.cgi;
and
there is an
"ALT=" attribute in the
"IMG" tag which contains the
text "CAUBE.AU ISP Logo Program
Participant".
A program participant must
maintain an Acceptable Uses Policy (AUP) that:
forbids
customers from sending unsolicited bulk
email through the participant's services;
forbids
customers from sending unsolicited bulk
email that advertises a web page or other
service which the customer offers through
the participant's services; and
forbids
customers who use unsolicited bulk email
from directing responses of any kind
through the participant's services.
A program participant must ensure
that each customer has read and agreed to the
terms of the AUP prior to allowing that customer
to use the participant's service.
A program participant must
maintain an address at all of the participant's
domain names for receiving complaints about
unsolicited bulk email. That address must be
"abuse". For example, if the
participant owns the domain name is
"isp.com.au", the participant must
maintain an address, "abuse@isp.com.au"
for receiving complaints.
A program participant must
enforce the AUP by:
where there is evidence
that the customer knew their actions were
unacceptable, immediate termination of
service; or
in other cases,
suspension of service in conjunction with
a warning, or termination of service, at
the discretion of the participant.
Nothing in this term is taken to
prevent the participant from having additional
enforcement measures in place..
In cases of a customer claiming
that they had nothing to do with the AUP
violation, the program participant must require a
written statement to that effect from the
customer, and should report any forgeries to the
appropriate law enforcement authorities.
A program participant must
maintain correct "in-addr.arpa", or
reverse DNS mappings for all of the hosts under
its control, such that
given the address of a
system, a query for the "PTR"
record for that address in the DNS gives
the host name of that system;
given the host name
discovered in (a), a query for the
"A" record for that host name
in the DNS gives the address from (a);
and
a person on seeing the
host name is reasonably able to deduce
the correct domain name for the handling
of abuse issues relating to that host
name.
A program participant must not
advertise by means of unsolicited bulk email.
A program participant must
protect its SMTP servers from unauthorised relay.
A program participant may use password protected
authentication systems, such as SMTP-after-POP,
to allow roaming users to use its SMTP servers
without allowing arbitrary remote clients to
relay off its servers.
In order to better support
roaming users, a program participant must cause
its name servers to have entries for
"smtp" and "mail", so that
customers who roam can configure their mail
clients to simply connect to "smtp" or
"mail", with no domain names, in order
to ensure that they are connecting to the correct
SMTP server. For example, if you supply a domain
name suffix of "dialup.isp.com.au" via
PPP or DHCP, there must be entries for
"mail.dialup.isp.com.au" and
"smtp.dialup.isp.com.au" so that a mail
client configured to simply connect to
"mail" or "smtp" will connect
to the correct servers.
CAUBE.AU may, at its sole
discretion, grant the participant the right to
use one of the White Hat Logos. The use of the
White Hat Logos is subject to the same rules as
the use of the Logo, except that a participant
must have received explicit permission to use the
White Hat Logos in advance.
CAUBE.AU, may terminate the right
of a participant to use any of the Logos if, in
the sole opinion of CAUBE.AU, the participant has
breached the terms of this program and failed to
sufficiently address and rectify such a breach.
CAUBE.AU may delegate the operation of this term
to its nominated agents or committees for
administering this program.
CAUBE.AU may alter the terms of
this program by giving sixty days notice. Such
notice is to be given by posting a message to the
USENET newsgroup "aus.net.mail", and by
posting the new terms to the CAUBE.AU web site.
The Logos remain the intellectual
property of CAUBE.AU, and participants
acknowledge this ownership and warrant that they
will not undertake any action, or omit to take
any reasonable action, which would either dilute
the value of the Logos or cause harm to the
reputation of CAUBE.AU.
These terms will be governed by
the laws of the Commonwealth of Australia and
for participants who
maintain a registered head office within
Australia, the state or territory in
which that registered head office is
located;
for other participants,
the state of New South Wales.
